FruitBasket General Terms and Conditions of Sale
1. Purpose
These General Terms and Conditions of Sale (GTC) define the rights and obligations between FruitBasket and its customers in the context of the sale and delivery of baskets of fresh fruits and vegetables in Mauritius.
2. Scope
These Terms and Conditions apply to all orders placed on the FruitBasket.mu website, whether one-off or as part of a subscription, by individuals or companies.
All orders imply full and complete acceptance of these Terms and Conditions.
3. Delivery area and method
FruitBasket exclusively offers home or business delivery.
Delivery is available throughout Mauritius, with the exception of the districts of Savane and Grand Port.
However, deliveries to these districts can only be made as part of group orders of an amount greater than or equal to Rs 4,900, subject to prior validation by FruitBasket.
No on-site collection, relay point or direct sales are offered.
For deliveries to businesses, the customer agrees to facilitate access to the premises (schedule, delivery authorization). FruitBasket cannot be held responsible for delivery failures due to access issues.
4. Products, quality, origin and supply
The baskets offered by FruitBasket are composed of fresh fruits and vegetables, selected according to seasonality, market availability and premium quality standards.
FruitBasket works with trusted suppliers, producers and farmers, selected for their reliability and commitment to product freshness.
For local fruits and vegetables, and in particular (non-exhaustive list): mangoes, lychees, passion fruits, papayas, bananas, limes, dragon fruits and other seasonal products, FruitBasket favours, as far as possible, farmers using zero pesticides or limiting the use of chemicals as much as possible when production conditions allow.
Some fruits and vegetables may be picked on the day of delivery or come directly from cold storage on the morning of the day of delivery, guaranteeing optimal freshness and the preservation of their nutritional qualities.
The images shown on the website are for illustrative purposes only. The contents of the baskets may vary to guarantee quality, freshness, and continuity of service.
5. Product Offer and Ordering Conditions
Vegetables are only available as part of pre-made baskets, and more specifically in the Essential basket.
FruitBasket does not offer retail sales of vegetables.
Fruits, however, can be ordered individually, depending on availability indicated on the website at the time of ordering.
The minimum order for any basket offered on the site is set at Rs 1490.
6. Prices and price variations
6.1 Prices displayed on the website
FruitBasket reserves the right to change the prices displayed on its website at any time, depending on changes in fruit and vegetable prices on the market, seasonality and supply costs.
The applicable prices are those in effect at the time the order is validated.
Any confirmed order will still be billed at the price displayed at the time of sale, even if prices are subsequently changed on the website.
6.2 Subscriptions
For subscription baskets, prices are fixed and guaranteed for the entire duration of the subscription. Market fluctuations are absorbed by FruitBasket.
The baskets vary depending on fruit availability and the season. The contents may be adjusted to maintain freshness, quality, and the premium level of service.
FruitBasket adjusts its baskets to offer a premium fruit and vegetable delivery service including product selection, freshness, a flexible delivery service adapted to the customer's schedule and an after-sales service allowing the replacement of certain fruits in case of dissatisfaction, under the conditions provided for in these Terms and Conditions.
This level of service is an exclusive offering provided by FruitBasket throughout Mauritius.
7. Product replacement and customer preferences
7.1 Baskets eligible for replacements
Product replacements are only made in standard baskets already composed and offered on the FruitBasket website, namely: Discovery, Discovery+, Essential, Premium and Premium+.
Replacements are made to guarantee freshness, quality or in case of product unavailability.
7.2 Customized baskets and specific orders
For customized baskets or specific orders placed on the site, no replacements are made, except with the explicit prior agreement of the customer.
7.3 Customer Preferences
The customer can indicate their dietary preferences or exclusions when registering or placing an order.
FruitBasket undertakes to take this into account as far as possible, without absolute guarantee, due to constraints related to seasonality and supply.
8. Hidden defects, refund and replacement procedure
Despite the care taken in selecting the products, some fruits or vegetables such as pineapple, watermelon, courgette or other similar products may have internal defects not visible externally.
If you are dissatisfied with the fruits or vegetables, you are invited to inform FruitBasket within forty-eight (48) hours of delivery, by providing a photo of the product in question.
After verification, FruitBasket will suggest the following, depending on the situation:
- product replacement with the next delivery as part of a subscription,
- or a suitable commercial solution (refund or credit note).
Any request submitted after this 48-hour period may not be considered.
9. Ordering, payment and delivery in case of absence
All orders are considered firm and final after validation.
Accepted payment methods include cash on delivery, payment via Juice, and any other method offered on the website.
For business customers (companies), FruitBasket may grant, upon prior agreement, a payment period of fourteen (14) days by bank transfer.
FruitBasket reserves the right to refuse or cancel an order in the event of a prior dispute or non-payment.
If the customer is not present at the time of delivery, FruitBasket may, only with the customer's prior consent, deliver to a neighbor, a relative or leave the basket outside the home (courtyard, terrace, secure area).
Without clear authorization, delivery may be postponed.
Any delivery made according to the customer's instructions is considered compliant. FruitBasket cannot be held responsible for any loss, theft, or damage after authorized delivery.
The customer agrees to report the possible presence of a dog or any animal that could pose a danger to the delivery person. If a risk is identified, FruitBasket reserves the right to refuse delivery until safety conditions are guaranteed.
10. Subscriptions – cancellation, pause and waste prevention
Customers can cancel their subscription at any time, free of charge.
However, in order to guarantee the freshness of the products and limit food waste, FruitBasket orders its fruits and vegetables in adjusted quantities from its suppliers.
The customer agrees to inform FruitBasket at least two weeks in advance of any cancellation, modification or pause of an upcoming delivery (travel, absence, etc.).
Any request submitted after this deadline may not be considered for the delivery in question.
11. Responsibility
FruitBasket cannot be held responsible for damages resulting from improper storage of products after delivery.
FruitBasket's liability is strictly limited to the amount of the order in question.
12. Force majeure
FruitBasket cannot be held responsible for any delay or inability to deliver due to an event beyond its control (bad weather, strikes, shortages, logistical problems, etc.).
13. Personal data
The personal data collected is used solely for order processing and customer relationship management, in accordance with the regulations applicable in Mauritius.
The customer is invited to consult the Privacy Policy available on the FruitBasket.mu website.
14. Applicable Law and Disputes
These General Terms and Conditions of Sale are governed by Mauritian law.
In the event of a dispute, an amicable solution will be sought before any legal action is taken.
